We found three breaches of the legal regulations relating to governance, and dignity and respect.

Staff did not always assess risks to people’s health and safety. Governance systems and management oversight were not effective in identifying or addressing areas for improvement. The culture of the service did not ensure people were always treated with dignity or respect.

However, there were enough staff to ensure people’s safety and meet their needs. People’s care experiences were used to inform care planning and review. Learning was used to improve service delivery. People used community facilities and lived in environments that were adapted to their needs and safety. Where people were deprived of their liberty this was done in accordance with the law.

We have asked the provider for an action plan in response to the concerns found at this assessment.

We have assessed the service against ‘Right support, right care, right culture’ guidance to make judgements about whether the provider guaranteed people with a learning disability and autistic people respect, equality, dignity, choices, independence, and good access to local communities that most people take for granted.

  1. Safe

    No rating

We have identified one breach of legal regulations. Management oversight of risk and care records was not robust. There was a failure to identify and mitigate the risks we identified during our assessment. However, care plans guided safe care. There were enough staff to support people safely. Safeguarding procedures protected people from abuse and avoidable harm. Medicines were managed safely.

  2. Effective

    Good

People’s needs were regularly assessed and reviewed. There was a multidisciplinary approach to assessment and care planning. This was supported by person-centred practices. People and those close to them were involved in planning their care. People had access to health and social care professionals and medical treatment. People’s rights were respected, and care and treatment provided in line with the requirements of the Mental Capacity Act 2005.

The Mental Capacity Act 2005 (MCA) provides a legal framework for making decisions on behalf of people who may lack the mental capacity to do so for themselves. The Act requires that, as far as possible, people make their own decisions and are helped to do so when needed. When they lack mental capacity to take decisions, any made on their behalf must be in their best interests and as least restrictive as possible.

  3. Caring

    Good

People did not have complete choice or control over their lives. There were some aspects of people’s care and environment where authorised restrictions were in place to keep people safe. Within these restrictions people were encouraged to make decisions about aspects of their care and how to spend their time. Relatives told us, “It is a good home. The staff are really caring.” And “They are very caring and passionate about what they do.”

  4. Responsive

    Good

People had access to care and treatment. People’s accessibility needs were taken into consideration including mobility and communication. People had communication assessments as part of their care planning pathway. People’s protected characteristics and diversity needs were considered in line with the Equality Act 2010. The Act ensures everyone is lawfully protected from discrimination.

  5. Well-led

    No rating

We identified two breaches of the legal regulations.

Governance processes and audit were not effective to ensure information within people’s care records was correct and guided safe practice. Management oversight was not effective to ensure people were treated with dignity and respect at all times. The company values were not widely known by staff and the behaviours of some staff did not show integrity or respect.

However, we also observed staff who did demonstrate integrity and respect for people. Staff felt supported by the registered manager and provider and enjoyed working at Jane House. There was partnership working with families, professionals, and other organisations.
